Prenuptial agreements are not automatically binding in Hong Kong, but the Court will give them significant weight if:

  • The agreement is fair and reasonable in its terms;
  • Both parties signed voluntarily, without pressure; and
  • Both parties received independent legal advice before signing.

Full and frank financial disclosure at the time of signing is also key to enforceability.

A prenuptial agreement should be signed well before the wedding — ideally at least one month in advance, with full financial disclosure and independent legal advice for each party. Signing too close to the wedding date raises concerns about undue pressure, which can reduce the weight given by the Court. In those situations, it’s recommended to also execute a postnuptial agreement after the wedding to confirm both parties remain bound.

An overseas prenuptial agreement is not automatically binding on Hong Kong courts, but it can be given weight in ancillary relief proceedings — provided it was entered into voluntarily, with proper legal advice, and the terms remain fair under Hong Kong law.

A postnuptial agreement (signed after marriage) should cover:

  • Division of assets in the event of divorce
  • Maintenance arrangements (if any)
  • Full financial disclosure from both parties

Like prenuptial agreements, postnups are not automatically binding but can carry strong weight if they are fair, voluntarily signed, and supported by independent legal advice for both parties.
